This document, together with all the documents mentioned in it, constitutes the legal bases that must regulate the use of this website (www.urbanima.com), hereafter URBÀNIMA (or “us”, “we”), and all purchase orders placed in it.  

Please read these Conditions and our Privacy and Cookie Policies carefully before using this website.

By using this website or placing an order you agree to these Conditions and to our Privacy and Cookie Policies, so if you do not agree with all the Conditions and the Privacy and Cookie Policy we suggest you do not continue using this website. If you have any questions about the Conditions or Privacy and Cookie Policies you can contact us through our contact channels.

Users who purchase any of our items shall be governed by the policies and conditions existing at the time of purchase. For these purposes, the texts of the Conditions of Purchase shall always include the date of their publication, in order to offer users legal certainty.

2. PURCHASE PROCESS AND CONTRACT CONDITIONS

2.1. HOW TO PLACE AN ORDER

Choose an item from our FOOTWEAR section. A page will appear with a complete description of the product and the option to ADD TO CART. You can purchase the product by clicking on the option to ADD TO CART.. 

2.2. USER REGISTRATION/ GUEST CHECKOUT

To place an order you must register or access as a guest. We need your details for the delivery, billing, contact, etc. To register or shop as a guest you must be over 18 years old. Orders will not be accepted if they are placed by someone without the necessary legal capacity to contract.

One of the advantages of registering is that you won’t need to provide all your details again for future purchases, needing only to log in with your username and password.

URBÀNIMA allows you to checkout as a guest. You will only be asked for the essential details needed to process your order. Once the purchase process is complete, you will be offered the possibility to register as a user or continue as an unregistered user..

2.3. PRODUCT AVAILABILITY

All orders are subject to product availability. Should there be any difficulties in supply or an item not be in stock, we will refund you any amount you may have paid.

2.4. SHOPPING CART

URBÀNIMA has a shopping cart to which you can add more than one item without having to send us your details again, allowing us to better manage your order. 

2.5. CHECKOUT PROCESS

The checkout process is automated. The steps to follow are shown in the shopping cart, that is linked to a payment gateway that manages the payment. We currently accept PayPal, Visa and Mastercard.

2.6. SHIPPING

Before completing your order you must select the shipping method that best suits your needs. Unless we have agreed otherwise, we will send you the order with the selected items without undue delay and within 30 calendar days from the date of the order confirmation. 

Please note that circumstances arising from the customization of the products, or unforeseen or extraordinary circumstances may affect the shipping date. 

If for any reason we should be unable to meet the shipping date, we will notify you and offer you the option to proceed with the purchase by setting a new shipping date or cancel the order with a full refund.

For the purposes of the present Terms and Conditions, a product will be deemed “delivered” at the moment in which you or an authorised third party acquires the material possession of the ordered products, which will be confirmed by signing the order receipt at the agreed shipping address.

2.7. IMPOSSIBILITY TO DELIVER

If it is impossible for your order to be delivered, we will try to find a safe place to leave it. If we cannot find one, your order will be returned to our warehouse. We will also leave you a note explaining where your order is located and how to get it sent back to you. If after 7 days since your order is available for its delivery the order has not been delivered for reasons not attributable to us, it will be understood that you wish to cancel the contract and we will consider it resolved. As a result of the termination of the contract: 

  • For orders from mainland Spain and the Balearic Islands, we will refund the amount paid by the customer, except for €6 corresponding to the return request.
  • For orders from any other location, we will refund the amount paid by the customer except for the shipping costs and an extra €6 corresponding to the return request.


2.8. IN-STORE PICK UP

If you chose an In-Store Pick Up, your order will be delivered to our store at Calle Castellón 16, bajo dcha. 46004 – València (Spain) within the time indicated during the purchasing process.

Once the order has been prepared, we will contact you to let you know that it’s ready to be picked up. You can pick up the order yourself, showing your order number and ID, or designate a third party to do so on your behalf, in which case it is they who must show the order number along with their ID.

These Conditions are also applicable to orders picked up in-store, without prejudice to any other regulations that may also be applicable.

2.9. PRICE 

The products published on www.urbanima.com include the prices with the corresponding taxes if applicable. Prices include VAT. Shipping costs do not appear in the FOOTWEAR section, but are included in the purchasing process so that users know at all times the total cost of the item they intend to purchase. The final price shown is the final price to be paid.

URBÀNIMA does not sell any product for €0, with a 100% discount or below its real cost; however, pricing errors may occur due to system or human error. URBÀNIMA reserves the right to cancel, prior notice to the customer, any order that may include a pricing error, any item at €0 or with a 100% discount, or any item whose price is mistakenly below its real cost. If you find any error of this type, please contact us to correct the error immediately.

Before you place an order bear in mind that orders from some countries may be subject to customs taxes or duties. These additional costs must be paid by the recipient of the package. In the case of placing an order but not paying those customs taxes or duties, the buyer will not be permitted to exchange or return the ordered product(s).

We do not deliver to Ceuta, Melilla, the Canary Islands or Corsica. For the United Kingdom, Norway, United States, Canada and Australia orders must be placed through Cerqular.com

2.10. PAYMENT

We accept the following payment methods:

  • VISA OR MASTERCARD SECURE ONLINE PAYMENT GATEWAY
  •  PPAYPAL. A service specially designed for those not satisfied with traditional payment methods. For more information visit http://www.paypal.com. 

URBÀNIMA is not responsible for the conditions under which these companies operate.

2.11. DELIVERY TIMES

URBÀNIMA will inform of the approximate deliver time on our website and/or during the purchasing process. Orders placed before 12:00PM (CET+1; CEST+2) on a business day

(Monday-Friday) will ship the same day. Orders placed after 12:00PM (CET+1; CEST+2) will be shipped on the next business day. Once the order is placed, delivery times may vary depending on the courier service used. Ordered products must be in stock.

Shipping costs will be displayed in the shopping cart prior to making the payment, so that the users know at all times the total cost of their purchase. 

2.12. RE – PACK

URBÀNIMA colabora con el proveedor de envases reutilizables Original RePack. RePack es una solución de embalaje reutilizable y retornable. El coste de utilizar esta solución sostenible es de 3,5€. Puede devolver el RePack vacío dejándolo caer en el buzón de correos más cercano, sin cargo, en cualquier parte del mundo. Simplemente doble el RePack dejando visible la etiqueta de dirección.

Para poder entregarle el código promocional necesitamos darle acceso a RePack a su dirección de correo electrónico. No se envía ninguna otra información personal a RePack y no tienen permiso para enviarle ningún otro correo electrónico además del correo electrónico de su cupón.

3. RETURN POLICY

3.1. RIGHT OF WITHDRAWAL

You are entitled to cancel your order without giving any reason for doing so within 14 calendar days from the date on which you or an appointed third party received it.

This is according to the provisions of Royal Legislative Decree 1/2007, of 16 November, Approving the Consolidated Text of the General Consumer and User Protection Act and Other Complementary Laws.

To return an order under the right of withdrawal, the product must be in perfect condition, in its original packaging, and with no signs of use.

As mentioned above, you have 14 calendar days to change your mind and exercise your right of withdrawal. Here you have the model from: MODELO DESISTIMIENTOMODEL WITHDRAWAL FORM.

Once you have filled in the model form, you must submit it to contact@urbanima.com

and we will indicate the way to verify the origin of the returned product and the refund of any money paid.

Its use is not mandatory. To comply with the withdrawal period, all you need to do is contact URBÀNIMA before the deadline expires.

If we find that the product has been tampered with, it will not fall under the right of withdrawal and, therefore, there will be no refund.

3.2. EXCHANGES, RETURNS AND WARRANTY

In order to request a product exchange in cases of error or damaged goods, the exchange period will be 30 calendar days from the day the product was received.

After 14 days there is no longer a right of withdrawal, but you can still request the exchange of your item for an equal one in perfect condition in cases of damaged goods or shipping error.

Items purchased on www.urbanima.com can be returned as long as they are in perfect condition and have not been used. Returns from Spain will be free of charge.

In cases of shipping error the product must be in perfect condition, unopened and with its original labelling intact. If you wish to return a product you must email contact@urbanima.com indicating the reasons for which you wish to do so.

We may require more information, photos, etc., before proceeding with the return process. After this first step, we will indicate the next steps to follow to send us the item so that we can send you the requested product in perfect condition.

In case of selling items that may be subject to a legal warranty, it will be the legally established one or the one offered by the manufacturer if it improves or extends said guarantee.

In case of products damaged in transit, please contact us immediately in order to manage it conveniently, as complaints must be processed within 24 hours from the moment you receive the damaged item.

3.3. COMMON PROVISIONS

Your right to withdraw from the contract will apply only to those products that are returned in the same conditions in which you received them.

In order to be refunded for any product, it must not have been used beyond merely opening the package and be in the same condition in which you received it, so we recommend a careful use of the product while it is in your possession.

Please return the item using or including all its original packaging, instructions and other documents that may accompany it.


4. DISCLAIMER OF LIABILITY

4.1. URBÀNIMA is not responsible for any access to third-party websites, so you must comply with the terms and conditions of such websites.

4.2. You acknowledge and accept that URBÀNIMA is not responsible for any damage caused by system interruption, delay, suspension or loss of data due to connection or equipment failure, unauthorised access to data, or any other damage you may suffer while using the services provided by URBÀNIMA. Regardless of this, we will strive to resolve any incident with utmost diligence.

4.3. URBÀNIMA does not guarantee the content of emails sent from or to our website, without prejudice to the security and diligence measures implemented and in accordance with industry standards at the time of implementation.

4.4. URBÀNIMA is not responsible for any loss or damage caused by the Customer in violation of these Terms and Conditions.

4.5. To use this website, you will need a compatible computer or device, an internet connection and one of the payment methods accepted by URBÀNIMA. The cost and any other expenses

and fees associated with the services and devices described in this clause are not covered by URBÀNIMA or by the Trader unless otherwise specified.

4.6. URBÀNIMA reserves the right to suspend or terminate the provision of its services, in whole or in part, and to take the necessary measures without prior notification to the Customer in order to maintain the quality of its service, in the following cases:

(I) Performing routine or emergency system maintenance tasks;

(II) In the event of a power surge;

(III) When URBÀNIMA detects a possible risk of interruption of the services.

(IV) To ensure the safety of our Customers, or when we deem it necessary for the good of the service we provide.


5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

5.1. You acknowledge and agree that all copyright, trademark and other industrial and intellectual property rights over the material or contents provided on the website belong to us or to those who granted us license for their use. You may use such material only in the manner expressly authorised by us or those who licensed us for its use. This does not prevent you from using this website to the extent necessary to copy information about your order or contact details.

5.2. You may not use, reproduce, copy, transform or transmit the contents published on our website www.urbanima.com without prior written authorization by their owner. If you have any questions regarding the property of any of the contents, services and/or features offered on this website, please contact us so we may help you.

5.3. Items for sale in our store are 100% original and authentic, subject to the copyright and intellectual property rights of their legitimate owner, so any type of action that may damage these rights may be prosecuted.  


6.LINKS FROM OUR WEBSITE

Our website may include links to third-party websites or material. These are provided for informational purposes only, and we do not have any control over the content of such websites or material. Therefore, we are not responsible for any damage or loss arising from their use.


7. OUR RIGHT TO MODIFY THESE CONDITIONS

We reserve the right to modify these Terms and Conditions. Any modification shall not be retroactive. If you do not agree with the changes made, we recommend you do not continue using our website.

You acknowledge and agree that you will be bound by the Terms and Conditions applicable to the website at any time and agree to comply with them accordingly.


8. GOVERNING LAW

These General Conditions shall be governed by, and construed in accordance with, Spanish law. URBÀNIMA and the user agree that any disputes concerning these General Conditions shall be subject to the jurisdiction of the courts determined by the address of URBÀNIMA.


9. COMPLAINTS & FEEDBACK

We always welcome feedback from our customers. Please send any complaints, feedback or queries through our contact channels or to the postal address indicated in clause 1 of these Conditions.

We also have official complaint forms available to our consumers and users. You can request them by calling (0034) 961879238 or through our contact channels.. You can also send your complaints through our contact channels or email contact@urbanima.com, and they will be handled by our customer service in the shortest time possible and, in any case, within the legally established time. If you, as a consumer, consider your rights to have been violated, you can send us your complaints to our email address contact@urbanima.com

in order to request an extrajudicial settlement of disputes.

In this sense, if your purchase has been made online through our website, in accordance with EU Regulation No 524/2013, we inform you that you have the right to ask for an extrajudicial settlement of consumer disputes at the following internet

¿Cómo saber mi talla?

En Urbànima te recomendamos que escojas tu talla habitual, pero para seleccionar un calzado plano puedes orientarte con la guía de tallas que incluimos en cada zapato. Si quieres saber cuanto te mide el pie, sigue los siguientes pasos:

1. Coloca un folio pegado a la pared.

2. Pon tu pie sobre el folio, pegando el talón contra la pared. Para una mayor precisión, usa los calcetines que sueles llevar habitualmente y mídete por la tarde, cuando el pie se encuentra en su dimensión más grande.

3. Marca en el folio justo donde termina el dedo más largo.

4. Con una regla mide la distancia entre el talón y la marca del dedo más largo.

5. Repítelo con el otro pie y recuerda la medida más larga.
